We do not represent or warrant that the information on our web site is accurate, complete, or current. This includes pricing and availability information. We reserve the right to correct any errors or omissions, and to change or update information at any time without giving prior notice.

Unless otherwise noted all materials, including images, illustrations, designs, icons, photographs, video clips, written, and other materials that appear as part of this site are copyrights, trademarks, trade dress and/or other forms of intellectual property owned, controlled, and/or used under license or with other legal authority by Unfltrd Passion. The site as a whole is protected by copyright and trade dress, all worldwide rights, titles and interest in and to which are owned by Unfltrd Passion.

Correction of Errors and Inaccuracies:

The information on the site may contain typographical errors or inaccuracies and may not be complete or current. Unfltrd Passion. therefore reserves the right to correct any errors, inaccuracies or omissions and to change or update information at any time with or without prior notice (including after you have submitted your order). Please note that such errors, inaccuracies or omissions may relate to product description, pricing, product availability, or otherwise.

Colors:

We have made efforts to display accurately the colors of products that appear at the Site. However, as the actual colors you see will depend on your monitor and/or other technological circumstance, we cannot and do not guarantee that your monitor’s display of any color will be accurate.

Return Policy:

Unfltrd Passion. does not accept returns for refunds, credits, or exchanges at this time. All sales are final.

If you have been in contact with us in regards to having a return/exchange approved, it is mandatory that you include proof of contact with our company in your return shipment. Please note, all returns must be included in original packaging accompanied by a copy of the order invoice. We cannot approve any returns/exchanges over 90 days old, no exceptions.

We will not accept any packages sent without authorization, any shipments received that have not been authorized will be refused/shipped back.

Please make sure that you have carefully reviewed your order prior to finalizing your purchase.

Shipping & Delivery:

All orders are shipped exclusively via UPS unless customer (you) explicitely requests another shipping method. International customers are responsible for custom duties and/or brokerage fees in addition to shipping cost assessed during checkout. All New York residents will incur sales tax as set by the State of New York and/or the County to which your delivery will be shipped. Please note that UPS does not deliver to APO/FPO addresses or P.O boxes.

Please allow 3 business days for order processing and payment verification, all orders bespoke, made to order and customer can expect to be notified.

Product Availability:

Although availability may be indicated on our site, we cannot guarantee product availability or immediate delivery. We reserve the right, without liability or prior notice to revise, discontinue, or cease to make available any or all products or to cancel any order.

Customer Privacy:

Unfltrd Passion respects our customers account information as private and confidential information and will never share this with any outside afflictions or individuals.

Sales Tax:

Sales Tax is charged to those orders shipped within the state New York. Sales Tax is not charged to orders shipped to the states outside of New York.

Customizer & Designer Platform

1. User-Generated Content & Ownership

By using the Unfltrd Passion Customizer & Designer Platform (“the Customizer”), you acknowledge and agree to the following:

Ownership (Subscribers vs. Free Users)

  • Subscribers (Paid Users): You retain full ownership of the designs you create using the Customizer.
  • Free Users (Non-Subscribers): You grant Unfltrd Passion a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute your designs for operational, promotional, and marketing purposes.
  • All Users: By uploading or creating content, you confirm that you own or have the rights to use all elements within your design.

Hosting & Storage

  • All designs created using the Customizer are stored on Unfltrd Passion’s servers for processing and fulfillment purposes.
  • We reserve the right to retain, archive, or remove content if it violates our terms, contains offensive material, or infringes upon copyrights.

Promotional Use & Platform Improvements

  • Unfltrd Passion may feature user-generated content in marketing, social media, or promotional materials.
  • If you do not want your design showcased, please contact us at info@unfltrdpassion.com.

2. Licensing & Intellectual Property

User Responsibility for Uploaded Content

  • You are responsible for ensuring that any uploaded images, designs, logos, or text do not infringe upon third-party copyrights, trademarks, or intellectual property rights.
  • Unfltrd Passion is not liable for copyright claims related to user-generated content.

Derivative Works & Custom Modifications

  • If you modify or customize any pre-existing design elements provided within the Customizer, Unfltrd Passion retains ownership of the original elements while you own your modifications.
  • You may not resell, redistribute, or claim exclusive rights to any pre-existing design templates provided by Unfltrd Passion.

3. Usage Restrictions & Prohibited Content

By using the Customizer, you agree NOT to create or upload content that:
❌ Infringes upon copyrights, trademarks, or intellectual property.
❌ Promotes violence, hate speech, discrimination, or illegal activity.
❌ Contains explicit, offensive, or obscene imagery.
❌ Impersonates a brand, business, or individual without authorization.

4. Order Fulfillment & Product Creation

Custom Orders Are Final Sale

  • Any product customized using the Customizer is final sale and cannot be returned or exchanged.
  • Please review all designs before submitting, as Unfltrd Passion is not responsible for user errors, typos, or design mistakes.

Production & Delivery Timelines

  • Custom orders require X-Y business days for processing, followed by standard shipping times.
  • Production times may vary based on order volume, fabric/material availability, and customization complexity.

Modifications & Cancellations

  • Once an order is placed, modifications are not guaranteed. Contact info@unfltrdpassion.com immediately if changes are needed.

5. Limitation of Liability & Platform Availability

No Guarantee of Uninterrupted Service

  • Unfltrd Passion reserves the right to modify, suspend, or discontinue the Customizer platform at any time without prior notice.
  • We are not responsible for technical issues, system outages, or data loss caused by third-party hosting services, internet failures, or cyberattacks.

Indemnification

  • By using the Customizer, you agree to indemnify and hold Unfltrd Passion harmless from any claims, damages, losses, or legal fees related to:
    • Copyright or trademark infringement claims from third parties.
    • Unauthorized use of copyrighted or offensive materials.
    • Misuse of the platform that results in harm, fraud, or reputation damage.

6. Subscription Benefits & Member Perks (If Applicable)

For users who subscribe to a paid membership plan, additional benefits include:

✔ Priority access to new tools, features, and updates.
✔ Exclusive resources, templates, and design elements.

Free users may upgrade at any time to retain full ownership of their designs.
